01 Acceptance of Terms
By accessing or using NexaAI services, you agree to be bound by these Terms and Conditions. If you do not agree to all terms, you may not use our services. These terms apply to all visitors, users, and clients of NexaAI.
02 Services Description
NexaAI provides AI-powered automation services including content generation, image creation, website auto-publishing, and social media management. The specific features available to you depend on your chosen subscription plan as outlined on our Pricing page.
03 Account Registration
To use NexaAI services, you must create an account with accurate and complete information. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. Notify us immediately at security@nexaai.com of any unauthorised use.
04 Subscription and Billing
NexaAI operates on a subscription model. You will be billed in advance on a monthly or annual basis depending on your chosen plan. Prices are in Indian Rupees (INR) unless otherwise specified. By providing payment details, you authorise NexaAI to charge your payment method for recurring subscription fees. We use secure, PCI-compliant payment processing.
05 Free Trial
NexaAI offers a 14-day free trial on eligible plans. No credit card is required to begin the free trial. At the end of the trial period, you must subscribe to a paid plan to continue using the service. During the trial, usage limits may apply.
06 Content Ownership
All content generated by NexaAI AI systems on your behalf (blog posts, images, captions, etc.) is owned by you upon generation. NexaAI grants you a perpetual, royalty-free licence to use, modify, and publish this content for your business purposes. NexaAI retains no ownership claim over generated content specific to your account.
07 Acceptable Use
You agree not to use NexaAI services to: (a) generate illegal, defamatory, hateful, or harmful content; (b) infringe any third-party intellectual property rights; (c) engage in spam or unsolicited communications; (d) resell or white-label NexaAI services without written permission; (e) attempt to reverse engineer our AI systems; or (f) violate any applicable laws or regulations.
08 Data and Privacy
NexaAI collects and processes data as described in our Privacy Policy. By using our services, you consent to this collection and processing. You retain ownership of all data you provide. We implement industry-standard security measures to protect your information.
09 Service Availability
NexaAI targets 99.9% uptime but does not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance. We are not liable for downtime resulting from factors outside our reasonable control including internet outages, third-party API failures, or force majeure events.
10 Third-Party Integrations
NexaAI integrates with third-party platforms (WordPress, Facebook, Instagram, LinkedIn, etc.). Use of these integrations is subject to those platforms' terms of service. NexaAI is not responsible for changes to third-party APIs or platform policy changes that may affect our service functionality.
11 Termination
You may cancel your subscription at any time from your account dashboard. NexaAI may suspend or terminate accounts that violate these terms, engage in fraudulent activity, or fail to pay applicable fees. Upon termination, access to the service will cease, though downloaded content remains yours.
12 Limitation of Liability
To the maximum extent permitted by law, NexaAI's total liability for any claims arising from use of our services shall not exceed the amounts paid by you in the 3 months preceding the claim. NexaAI is not liable for indirect, incidental, or consequential damages including loss of profits or business opportunities.
13 Changes to Terms
NexaAI reserves the right to modify these terms at any time. We will notify users of material changes via email or in-app notification at least 14 days before they take effect. Continued use of the service after changes constitutes acceptance.
14 Governing Law
These Terms are governed by the laws of India. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of courts in Bangalore, Karnataka, India.
